Description

Verso: Legal document: agreement with the Qodesh. Dating: ca. 1160. An agreement is concluded between a certain Ṣubḥ and his wife, and the qodesh, represented by Abū Naṣr Yeshaʿyahu ha-Levi, the general administrator of the estates of the qodesh. Since the couple own nine qarārīṭ (=3/8) of the house of which the qodesh owns the rest, the repairs needed in the house could not be made without their collaboration. As a pledge for their part of the cost, they temporarily waive the ownership rights over their part as long as Yeshaʿyahu ha-Levi wants it. They also will accept the sum of the expenditures stated by him without question. (Information from Gil, Documents, pp. 292 #62)

  1. There were present (in court) Ṣubḥ and his wife and it was legally acquired from both of them that 

  2. they relinquish any claim to the 9 qīrāṭs of 

  3. the compound known as Dār al-Ṣabbāgh, 

  4. Shirkat al-ʿAniyīm, which is in Qaṣr al-Shamʿ 

  5. in the lane of al-Ḥarrānī. The two of them will in no way 

  6. sell, or donate, or rent it, 

  7. or bring in tenants, or collect any 

  8. rent, until our Master Isaiah has received the full acquittal 

  9. of what he will say .. of theirs, namely those 9 (qīrāṭs) 

  10.  There were present Ṣubḥ and his wife and it was legally acquired 

  11. from both of them together that they 

  12. (12-14) accepted that the Honorable al-Shaykh (A)bū Naṣr, our Master Isaiah, the administrator of the Estate of the Poor, should handle for them the repairs of 1⁄4 + 1/8 of the compound

  15. owned by them in Fustat, in Qaṣr al-Shamʿ, in the lane 

  16. of al-Ḥarrānī, known as Dār b. al-Ṣabbāgh. Also, that they will fully trust him 

  17. regarding (the sum) which, he will say, was spent for 

  18. (18-19) the said repairs, just as (one would trust) two able and trustworthy witnesses. They allowed him (to do) whatever he

  20. would find necessary regarding this (matter). Both of them together….
