Description

Fragment of a ketubba (marriage contract) which stipulates that the bride would move from Tyre to Akko in twelve months, ca. 1028-1037. The bride's father gave her an appartment in Acre where the couple will live, under the condition that he (the father) can stay in the appartment with them whenever he wants, alone with other family members, for a visit or for good.   1. [... when she is (still) under] his jurisdiction a division will be made of the land and what  
  2. and what remains of her dowry into two equal portions. Half her husband will acquire,  
  3. and half will return to the house of her fathers. And it is a monetary stipulation (and) is valid. And 
  4. Manṣūr, this groom, acknowledged that he received in full all th[at] is written and specified  
  5. above. And he said: "I am obligated to make payment, whether myself or from my heirs who will stand after me.  
  6. And all things that I possess and that I shall acquire, whether real estate or movables
  7. will be surety and guarantees for the payment of this marriage contract.” And they stipulated between themselves con-
  8. -cerning hate and love and life and death and all the court stipulations from beginning
  9. to end. And they also stipulated between themselves that Ḥaẓiyya would live in Tyre twelve  
  10. months, and afterwards he will move her to the city of Akko, without delaying or deferring.
  11. Further they stipulated between themselves: If m(aster) Nathan, her father, should happen to go to Akko, after
  12. his daughter Ḥaẓiyya goes (there), he will live in this house, whether he is alone or his wife  
  13. is with him and his children, whether to visit or to dwell (there) all his life, because on this condition he had given it to his daughter
  14. Ḥaẓiyya; and he had imposed on her this stipulation. Manṣūr, her husband, obligated himself by it without (any) protest 
  15. and without hesitating. And the two sides took upon themselves the security and stringency of this  
  16. deed according to the strength and stringency of all valid deeds, verified in court
  17. not like promises nor like formularies of documents. And with this understanding, the two sides concluded  
  18. and consented, not being coerced nor compelled; and they told the scribe  
  19. to write and the witnesses to testify. And we performed with them a complete, strict qinyan,  
  20. with an implement fit for doing this, for all that is written and specified above. Valid,  
  21. correct, and verified is this marriage contract wherever produced and read, whether 
  22. according to the statutes of our lords the sages or according to the laws of the gentiles. May he build and prosper. In good order.
  23. The papers are three. There is written on the joint, perpendicularly, in two places "true and corr[ect]."
  24. And the number of lines is ninety-four. Strong and firm.
  25. "I have read this copy and have transcribed the testimony which is in the ketubba. And it is  
  26. correct,” written by Joseph ha-Levi b. R. Manasseh (who) r(ests in) E(den). 
  27. Mevorakh b. Menahem (whose) s(oul is at) r(est).
  28. Samuel b. R. Moses he-ḥaver (who) r(ests in) E(den).
