Court records, all concerning the same persons. Recto: Sason b. Natan sues Moshe b. Moshe ha-Levi known as Ibn Majjān concerning a dispute over the reduction in price in a sale of antimony on credit after the baskets split open and were found to contain a lot of dirt. Contains important details about the role of the wakīl al-tujjār and the broker (dallāl). Dated: Thursday, 21 Adar 1409 (25 February 1098). Continues elsewhere. [Sason b. - On Thursday, the 21st of Adar,
- in the year 1409 of the era according to which we are accustomed to reckon
- in Fustat of Egypt, which is situated on the Nile river, the following occurred:
- There appeared before the court, instituted by his honor, his greatness, his holiness, our teacher, our master,
- our lord Mevorakh, Chief of Discernment, Sage of the Yeshiva, (member of the) Great Sanhedrin, Prince
- of Princes, Strength of the House of Israel, may his glory increase, M. Sason b. Natan, and M. Moshe
- ha-Levi b. Moshe. M. Sason claimed that M. Moshe
- had come with him to his storehouse and asked to be offered a basket of antimony; he opened it and looked at it,
- \\and the price was fixed at five dinars for one Laythī qinṭār, payable after four months.// (Moshe) called a weigher and porters, but while the basket was transported,
- it burst, whereupon M. Moshe said: "There is much earth in this basket. How much reduction do you grant me?"
- I (Sason) said to him: "I have bought a number of such baskets; I shall grant you the same reduction as that made in my favor by the representative of the merchants."
- Upon this, (Moshe) said: "I bought \\antimony// through Ben Salmān, the broker, and he reduced the price by the value of thirty
- pounds' weight per basket." I (Sason) replied that I agreed to accept the evaluation of Abū ʿAlī b. Salmān; whatever he said,
- I would accept. Then (Moshe), after having divided the load into two baskets and having them transported away by porters,
- was met by Ḥusayn al-Dimashqī, who asked to be offered some of the antimony; he (Moshe) gave him a sample and, winking(?)
- his eye, said to him: "It was bought \\from that man//, twenty (pounds) for a dinar." On the following day, M. Moshe came to me (Sason)
- and asked me to fetch Abū ʿAlī, that he should evaluate the reduction. I (Sason) brought Abū ʿAlī
- to his house (dār), and in the presence of Isḥāq b. Ḥunayn, Abū ʿAlī evaluated the antimony
- and ruled that the reduction should be fifteen, but (Moshe) swore that he agreed solely to thirty, whereupon I (Sason) said
- that I would grant only what the broker had fixed. I (Sason) waited until the stipulated time of payment, which I
- now demand from him. Asked about this, M. Moshe declared,
- "I agreed to buy the antimony for the price
- mentioned. However, at the time of the weighing, the basket burst, and I saw the antimony,
- \\and its weight was three hundred and eighty-four pounds."//
