תיאור

Document of sale dated Rabīʿ II 405 AH from the Fayyūm. Transaction between Rabābīl, the son of Mīnā, and Qarhīwah and Sariyya the daughters of Jirjah. Jirjah is the grandfather of Rabābīl which makes Qarhīwah and Sarīh his aunts. Sarīh’s name appears in another document almost 50 years after. While describing the boundaries of the object of sale, her house is mentioned [P.Vind.inv. A.Ch. 10254]. The object of sale in this document is the inheritance of the two aunts from their father, which is four shares minus one eighth of their parental house. According to the document the rest of shares of the house belong to Rabābīl’s father, Mīnā, and his uncle, Suwayrus. He bought these shares for a price of two dīnārs and fourteen carats.   3. هذا ما اشترا رببيل بن مينا بن جرجة التطونی من قرهيوه و سريه بنات جرج ة بن شنوده و هما اجمعين
  4. من سکان ططون من قرا كورة الفيوم اشترا منهم حصتهما و مورثهما من ابيهم جرجة بن شنوده
  5. أربعة اسهم غير ثُمن سهم من اربعه و عشرين سهما مشاع غير مقسوم بينهما و بين اخوتهم
  6. مينا بن جرجة و سويرس أخوه اشترا رببيل بن مينا ين جرجة هذه الأربعة اسهم غير ثمن سهم من المنزل
  7. المعروف بمنزل بياق بحده و حدوده و مدخله و مخرجه و كل حق له داخل فيه

  12. اشترا ذلک کله بخشبه و ابوابه و جميع مرافقه بدينارين و اربع اعشر قيراط
  13. عينا ذهبا وازنه جياده مما تتعاملوا به مصر و اعمالها قبضت قرهبوه
  14. و اختها سريه هذا الثمن تاما وافيا و تبرأو من هذا الملك براة قبض و استيفا
  15. و سلموه الی رببيل بن مينا و تسلمه و ملكه و حازه و صارا مالا من ماله و ملك من ملكه
  16. ان شا باع و ان شا وهب و ان شا سکن فيها ما کانت من علقة او تبيعة او طارئ لدين
  17. او مستحق لميراث فنفاذ ذلك و خلاصه علي قرهيوه و اختها سريه بنات جرجة بن شنوده
  18. من خالص ما لها بالغ ما بلغ و ذلک فی صحه عقولهم و ابدانهم و جواز امورهم طائعين غير مکرهين
  19. و لا مجبرين طيبه بذلک انفسهم و کتب ذلک فی شهر ربيع الاخر سنه خمس و اربع مايه

  1. The validity of this document was confirmed before me. It was written by Ḥasan ibn ʾIbrāhīm ibn Rizq in his (own) handwriting on its date.
  2. In the name of God, the Compassionate, the Merciful
  3. This is what Rabābīl ibn Mīnā ibn Ǧirǧah al-Ṭuṭūni has bought from Qarhīwah and Sarīh the daughters of Ǧirǧah the son of Shanūdah and they are both [numbered]
  4. Among the inhabitants of Ṭuṭūn, one of the villages in the district of Fayyūm. He bought from them both their share and their inheritance from their father, Ǧirǧah ibn Shanūdah,
  5. This being four shares less an eighth of a share from the twenty-four shares, held in common, not divided between them and their brothers,
  6. Mīnā ibn Ǧirǧah and his brother, Suwayrus. Rabābīl ibn Mīnā ibn Ǧirǧah bought these four shares less an eighth of a share of the house
  7. known as the house of Biyāq to its limit and its boundaries, with its entrance and exit, and every right within it
  8. and every [right] outside it, and what is enclosed by [its] four boundaries. The first boundary, and that is the southern one extends to the house of Ḥasan.
  9. Its second boundary, that is the northern boundary, extends to the spacious house known as the house of the bishop.
  10. Its third boundary, that is the western one, extends to the pavilion which belongs to Ṭāhir ibn Ḥasan ibn Rizq. And its
  11. fourth boundary, that is the eastern one, is (formed by) the thoroughfare to which the door (of the property) gives access. The entrance and the exit (of the property) are from this (side).
  12. He bought all of this property with its timbers, doors, and all its facilities (i.e. washroom and kitchen) for two dīnārs and fourteen carats
  13. in gold coins, of full weight and good alloy, from the ones customary in Egypt and its administrative districts. Qarhīwah received
  14. this price, along with her sister Sarīh, in full and completely. And they were released of the (ownership of this) property by means of a receipt (acknowledging that) they have received and taken over (the price) fully.
  15. And they delivered it to Rabābīl ibn Mīnā. And he received it, and acquired it, and possessed it. It became part of his wealth and among his properties.

  16. If he wishes he may sell it. If he wishes he can give it away as gift. If he wishes he may reside in it. Whatever arises by way of an attachment, right due, a creditor
  17. or someone having right to an inheritance, then the execution of that and its clearing is the obligation of Gharhīwah and her sister Sīrah, the daughters of Ǧirǧah ibn Shanūdah
  18. From her own property whatever it may amount to. [They performed this transaction] while being sound in mind and body, legally capable of conducting their affairs, acting willingly, not forced

  19. nor constrained, and while being pleased with it. This document was written in the month Rabīʿ al-ʾĀkhar of the year four hundred and five.

  1. Mūsā ibn ʿUbayd testified to all that is contained in this document and wrote in his (own) handwriting.
  2. Dāwūd ibn ʿAbd al-Raḥmān testified to all that is contained in this document and wrote in his (own) handwriting.
  3. ʾIdrīs ibn al-Ḥasan ibn ʾAbū Ḥidah testified to all that is contained in this document and wrote in his (own) handwriting.
  4. ʿAlyān ibn ʾIbrāhīm testified to all that is in this document and wrote in his (own) handwriting.
  5. Abū ʾIsḥāq ibn Yūsuf testified to all that is contained in this document. This was written on his behalf by his instruction and in his presence.
  6. [on the right side] Yūsuf ibn Wahab to all that is contained in this document and wrote in his (own) handwriting.
