מסמך משפטי NLI CAHJP ET-Ca. 63תיאור
A photocopy of a Muslim court deed concerning a conflict between the Qaraite supervisor on Qaraite endowments in Jerusalem, and a tenant, from the year 1583 CE. Current location of the original document, or how or from where its photocopy arrived the NLI, are unknown at the moment. It might be related to the circumstances detailed in the description of PGPID 40643 , PGPID 40644 , PGPID 40645. The supervisor's name is Suleymān b. ʿAbd al-ʿAzīz b. ʿAbd al-Jaʿafār, so he probably was the son of the supervisor mentioned in PGPID 40644 (from 1563 CE). The tenant is named Barūkh b. Avraham the Jew from Constantinople. The property under dispute is described as located in the Qaraite neighborhood (maḥallat al-qarāʾīyīn). It was dedicated as an endowment by the father of the said Suleymān, as is detailed in a court deed brought forth, dated 17th of Dhū al-Ḥijja 966 AV (20.9.1559 CE.( According to the property described and its equivalent date, the deed from 1559 mentioned here seems to be the same one that was brought forth also in the discussion on 1563, as mentioned in that deed (PGPID 40644). The property is described as bordering the Jewish bakery from the south, the public road from the east, the house of Zaytūn the Jew from the north, and the public road from the west. The court deed describes how Barūkh eventually admitted that he is not a resident of Jerusalem, nor a Qaraite, so he is not entitled to live in the endowed property. The court ruled he should evacuate the property. This was signed on the 19TH of Rabīʿ II 991 AH (12.5.1583 CE). The two persons mentioned in this document are also mentioned in a document from the Jerusalem Muslim court Sijjil from 1584 CE, published by Amnon Cohen (no. 373 in his volume on the 16th century), where they are also in dispute over dwelling rights and compensations for investments in an endowed property, in a location close by, which also seems to be one of the endowed properties described in PGPID 40644.
