Description

Deed of acknowledgment (iqrār). In Arabic script. Dated: 529 AH = 1134/35 CE. The muqirr is Bū Saʿd b. Hibatallāh al-Isrāʾīlī. Mentions a loan of 3.5 dinars and the region of the Upper Ṣaʿīd (al-Ṣaʿīd al-Aʿlā, southernmost Egypt). Could be a contract for a tax farm, or a partnership agreement in one. Refers to "the customary agricultural activities" (... al-filāḥāt ʿalā jārī al-ʿāda) and a stipulation that "when he fails to produce the aforementioned receipt in the name of the aforementioned tax farmer, he shall become liable for the aforementioned sum from his own money" (ومتا عدم احضار الوصول المذكور باسم الضامن المذكور كان عليه القيام بالمبلغ المذكور من ماله).   2. أقر بو سعد بن هبة الله الاسرائلي التاجـ[ـر (؟) واشهد على نفسه في صحة منه وجواز امر من] 
  3. غير قهر ولا جـ[ـبر ولا اكراه ولا سهو ولا غلط ولا شي من جميع مفسدات الشهادة انه]
  4. عرض له بتاريخ سنة تسع وعشرين وخمسماىة [
  5. ثلثة دنانير ونصف كان قرضا عليه ومعه بين[
  6. بالمبلغ المذكور لجهبذ الديوان ……..[ ] ـع من الصعيد الاعلا [       ] [
  7. يكمل الفلاحات على جاري العادة ومتا عدم إحضار الوصول المذكور باسم الضامن المذكور 
  8. كان عليه القيام بالمبلغ المذكور من ماله وصلب حاله متا احب واختار غير مدافعة ولا 
  9. ممانعة ولا احتجاج بحجة ولا اعتلال بعلة وذلك اقر  واشهد على نفسه طوعا وذلك يوم … شهر رجب

  1. In the name of God, the merciful, the compassionate.
  2. Bū Saʿd b. Hibatallāh the Jewish trad[er] acknowledged [and testified, in sound health and free will]
  3. without compulsion, without d[uress, without force, without negligence, without error, without any of the factors that invalidate testimony, that he]
  4. has submitted to him, on the date of the year 529 [                          ]
  5. 3½ dīnārs that were in commenda (qiraḍ) of his and with him between [him and Fulān b. Fulān]
  6. the aforementioned amount to the jahbadh of the dīwān .....[     ] from the Upper Ṣaʿīd [                 ]
  7. fulfill the sharecropping as normally carried out. When he fails to present the aforementioned receipt in the name of the aforementioned ḍāmin,
  8. he must make good on the aforementioned amount from his own money that he alone possesses, whenever (the ḍāmin) prefers and chooses, without resistance, without
  9. opposition, without argument and without pretext. He acknowledged and testified willingly on the day ... the month of Rajab
  10. of the year 529, two months (?)
