Recto: deed in which ʿUmar b. Mūsā, a dealer in oil, leases the lower floor of a house in Fusṭāṭ from Yaʾʾāsa bint Ismaʿīl al-Kohen ‘the Jewess’. The deed provides a detailed physical description of ʿUmar: ‘average stature, pure reddy-brown in complexion, a smooth broad forehead, fine eyebrows separated in the middle, fleshy eye-lids, dark brown eyes, a wide, thick nose, prominent cheekbones and a round beard’. The property abuts the house of Abū ʿAbdallāh Muḥammad b. ʿAbd al-Wāḥid b. ʿAlī, the house of Abū l-Ḥusayn Ismaʿīl b. al-Ḥusayn al-ʿAbbāsī, and the house of the daughter of Abū l-Ḥusayn Ismaʿīl b. al-Ḥusayn al-ʿAbbāsī. Dated Ḏū al-Qaʿda 520 AH (= November 1126 CE). Futūḥ b. Faḍl and Abū ʿUmar Daʾūd b. Ḥasan formally recognised the lessor. Witnessed by ʿAbd al-Bāqī b. Ibrahim Ibn al-Salam, Muḥammad b. Ḥasan. Aḥmad b. al-Ḥusayn, and ʿAbdallāh b. […] b. Aḥmad. Verso: confirmation that the payments specified on recto have been received, written by ʿAbd al-Wahhāb b. Aḥmad. (Information from CUDL)

  1. بسم الله الرحمن الرحيم الحمد لله حمد الشاكرين
  2. هذا ما استاجر عمر بن موسى الزيات وهو يومئذ رجل معتدل القامة
  3. اسمر اللون رقيق السمرة تعلوه حمرة واضح الجبهة صلتها ابلج ما بين الحاجبين
  4. از جهما ابخص اشهل اختم الانف غليظه موجن مستدير اللحية من يااسه
  5. ابنة اسمعيل المعروف والدها بالكوهان اليهودية استاجر
  6. منها صفقة واحدة وعقدا واحدا جميع القاعة السفل التي ذكرت هذه
  7. الاجرة انها من حقوق الدار التي لها وفى ملكها ملكا صحيحا وحقا واجبا
  8. في يدها وهي ذات الباب المربع والمجلس الذي على يسار من دخلها
  9. والصفة المقابلة له والمرحاض الذى على يمنة الداخل لهذه القاعة
  10. المذكورة وهى بفسطاط مصر فى الزقاق الغير نافذ المعروف
  11. بزقاق صدقة ولها حدود اربعة حدها الأول وهو القبلي ينتهى الى الدار
  12. الكبرى التي من حبس خلف الكندى والحد الثانى وهو البحرى ينتهى الى
  13. الطريق الفاصل فيما بين هذه الدار وبين الدار المعروفة كانت بالشيخ ابي عبد الله
  14. محمد بن عبد الواحد بن على المعدل كان بمصر ثم عرفت بورثته والحد
  15. الثالث وهو الشرقى ينتهى الى الدار المعروفة بالشريف ابي الحسين اسمعيل
  16. بن الحسين العباسي المعدل كان بمصر ثم بورثته والحد الغربي ينتهي
  17. الى الدار المعروفة بابنة الشريف ابى الحسين العباسي المذكور بحدود ذلك
  18. كله وحقوقه ومرافقه ومرتفقاته خلا المنزلين العاليين على
  19. هذه القاعة فانهما لم يدخلا ولا شي منها في جميع ما وقعت عليه هذه الاجارة
  20. وجميع ما وقعت عليه هذه الاجارة متفرغ لا شاغل له لمدة سنة
  21. واحدة كاملة اولها مستهل ذو القعدة من سنة عشرين وخمس مائة
  22. واخرها انقضا شوال من سنة احد وعشرين وخمس مائة باجرة مبلغها
  23. في هذه المدة ثمنية واربعين درهما ورقا جيادا وازنة مما يتعامل بها
  24. بمصر حسابا لكل شهر من ذلك اربعة دراهم اجارة صحيحة ماضية مقسطة
  25. هذه الاجرة على هذا المستاجر يقوم بذلك لهذه الاجرة مشاهرة
  26. قسط كل شهر منها فى سلخه بغير مدافعة ولا ممانعة ولا يمين ولا محاكمة
  27. وسلمت هذه الاجرة الى هذا المستاجر جميع ما وقعت عليه هذه الاجارة
  28. وتسلم ذلك منها وصار فى يده ووجب له الانتفاع بذلك وسكنه والحزن فيه
  29. طول هذه المدة والى انقضائها وتعاقدا هذه الاجارة بعد الرؤية لذلك
  30. وتفرقا بالابدان بعد تمامها ووجوبها وعن تراض بها وانفاذ لحكمها
  31. وضمنت الاجرة للمستاجر الدرك في ذلك كله شهد على اقرار الاجرة
  32. والمستاجر المذكورين فيه بما فيه بعد قراته عليهما وذلك في اليوم الخامس
  33. من ذي القعدة فى سنة عشرين وخمس مائة هـ وعرف بهذه المواجرة فتوح بن فضل الوكيل
  34. بباب الحكم بمصر وابو عمر داود بن حسن الارجواني اليهودى وعليه شهد في تاريخه
  35. فيه حرف مصلح عمر وهو صحيح

Recto 

  1. In the name of God, the merciful and compassionate. Praise be to God with the praise of those who give thanks.  

  2. This is what ʿUmar ibn Mūsā, the dealer in oil, who on this day is a man of  average stature,  

  3. pure reddy-brown in complexion, with a smooth broad forehead, with fine eyebrows separated in the middle,  

  4. with fleshy eye-lids, dark brown eyes, a wide, thick nose, prominent cheekbones  and a round beard, leased from Yaʾʾāsa (?) 

  5. ibnat Ismaʿīl, whose father is know as aI-Kohen, the Jewess. He leased

  6. from her, with one clapping of the hands and one contract, all the lower floor that this  

  7. lessor stated was one of the rights of the house belonging to her and in her ownership, as a valid asset and a right with legal force,  

  8. in her possession. It has a rectangular door, a living room on the left of anyone entering it,  

  9. a bench opposite it and a washroom on the right of anyone entering this  aforementioned ground floor.  

  10. It is in Fusṭāṭ- Miṣr, in the cul-de-sac street known  

  11. as Ṣadaqa street. It has four boundaries. Its first boundary, which is the southern, extends to the large house  

  12. that is part of the foundation of Khalaf al-Kindī. The second boundary, which is  the northern, extends to  

  13. the road dividing this house from the house that used to be known by (the name of) the elder Abū ʿAbdallāh  

  14. Muḥammad ibn ʿAbd al-Wāḥid ibn ʿAlī, formerly an accredited witness in Fusṭāṭ,  then subsequently known by (the name of) his heirs.  

  15. The third side, which is the eastern, used to be known by (the name of) the sharīf Abū al-Ḥusayn Ismaʿīl  

  16. ibn al-Ḥusayn al-ʿAbbāsī, formerly an accredited witness in Fusṭāṭ, then  subsequently by (the name of) his heirs. The western boundary extends

  17. to the house known by (the name of) the daughter of the aforementioned sharīf Abū al-Ḥusayn al-ʿAbbāsī. (He leased it) with all its boundaries,

  18. rights, amenities, and facilities, except for the apartments situated above

  19. this ground floor, for neither they, nor any part of them, have been included in  everything that this lease entailed,  

  20. everything that this lease entailed being free, without encumbrance. (He leased it)  for a period of one  

  21. complete year, beginning on the first day of Dhū al-Qaʿda of the year five-hundred and twenty  

  22. and ending on the last day of Shawwāl of the year five-hundred and twenty-one,  for a rent  

  23. in this period amounting to forty-eight dirhams, waraq, of good alloy, full weight, which are used as currency  

  24.  in Fusṭāṭ, reckoning at four dirhams for each month thereof, with a valid, operative lease,  

  25. this rent being payable by this lessee in instalments. He undertakes to pay this to this lessor monthly,  

  26. an instalment every month at its end, without any delay, withholding, oath, or litigation.  

  27. This lessor handed over to this lessee everything that this lease entailed

  28. and he received that from her and it passed into his possession. His right to have the usufruct of it, dwell in it and store in it  

  29. throughout this period until its end came into force. They contracted together this lease after having inspected this (property)  

  30. and separated physically after its completion and coming into force, mutually satisfied with it and executing its provisions.  

  31. The lessor granted the lessee a warranty against any defect in title regarding all of that. The acknowledgement by the lessor  

  32. and the lessee mentioned herein of what is included herein was witnessed, after it  had been read to them. This was on the fifth day  

  33. of Dhū al-Qaʿda in the year five-hundred and and twenty. Futūḥ ibn Faḍl, the  representative  

  34. at the al-Ḥukm gate in Fusṭāṭ, formally recognized this lessor and also Abū ʿUmar Dāʾūd ibn Ḥasan, the Jewish manufacturer of purple cloth, and it was witnessed on its date.  

  35. It contains a corrected word: ʿUmar, which is correct.  

Witness Clauses 

1. ʿAbd al-Bāqī ibn Ibrāhīm ibn al-Salam testified to  

2. the acknowledgement by the woman lessor and the lessee of what is contained  herein. ....... .  

3. mentioned herein, on its date (valid).  

4-5. I, Muḥammad ibn Ḥasan ibn Aḥmad ibn al-Ḥusayn, was called by the lessee to witness his acknowledgement, in  

6. the first ten days of Dhū al-Qaʿda in the year five-hundred and twenty.  

7.  ʿAbdallāh ibn ... ibn Aḥmad (valid) testified  

8. to the acknowledgement by the lessor and the lessee of what is contained herein  

9. in the first ten days of Dhū al-Qaʿda.

Verso 

  1. I have received in full (what is stipulated on) the recto of this lease up to the beginning  

  2. of Ramaḍān.  

  3. I have received everything (that is stipulated) on the recto of this document.  

  4. The lessor named on the recto called me to witness her receipt  

  5. of the rent that was recorded as being owed by the lessee on the recto.

  6. The lease came to an end and he contracted another lease, 

  7. the monthly payment of which .... the year five-hundred and twenty-one .... (valid)  

  8. Written by ʿAbd al-Wahhāb ibn Aḥmad on its date (valid).
