Description

Legal record (#83) in a court register/pinqas from a Karaite beit din in Cairo (on f. 29r of Yevr.-Arab. I 328). Dated 17 Elul 5325 AM (1565 CE). Marital dispute case resulting in the divorce of Avraham b. David al-Levi and Hanā bt. Moshe al-Maghribī. The record notes that a "quarrel and beating" took place between the couple and, thus, Avraham grants his wife a divorce. Based on the case's structure, Avraham may have sworn an oath in a previous marital dispute resolution or in their betrothal/ketubba conditions that if he raised a hand to his wife ever again, then she would be able to seek a divorce in court. Hanā, in turn, releases her husband from the obligations of returning her dowry and trousseau items. The record then notes, somewhat abruptly, that a quantity of wine was received by the Dār Simḥa Synagogue. This was likely a fine that Avraham had to pay for breaking the terms of a previous dispute resolution or betrothal (akin to PGPID 41609, for example). In early modern Karaite geniza documents, these penalties more commonly appear as contributions/fines of olive oil to the Dār Simḥa Synagogue. MCD.
