Description

Legal document. Partnership agreement. Dating: no earlier than 1415 CE, based on the currency niṣf fiḍḍa (medin). The partners are Riḍā b. ʿAbd al-ʿAzīz b. Riḍā and Yeshuʿa Dukhān (Dakhkhān? Dakkān?), in the manufacture and sale of cheese and other dairy products, for an unspecified fixed period. Each partner contributes both labor and capital: Riḍā is to be responsible for manufacture in the cheesemaking courtyard, bringing fifty qintār of halloumi cheese to the partnership. Yeshuʿa is to be responsible for sales, remaining in the shop and investing 1,000 silver half-dirhams, to be brought by Yeshuʿa in payments according to a schedule (see lines 10-12). Riḍā is to keep accounts. Profits and losses are to be divided equally, including rent for both the shop and the courtyard. Line 13 refers to the trustworthiness of the partners, important in this case since the two partners will not be working side by side.   1. his partner, a partnership was contracted between the teacher Raḍī b. the late ‘Abd al-
  2. ‘Azīz b. Raḍī and between the teacher Yeshu‘a Dukhān, for the manufacture of cheese and other
  3. things. Raḍī will stay in the courtyard and Dukhān will stay in the shop. All that which
  4. God will obtain for them and profit them in any manner and (even an item) found on the ground,
  5. they will divide between themselves in equal parts. Likewise with discrepancy and loss,
  6. and the payment to the market superintendent and the bank(ing fee,) and the rent of the shop and the courtyard, all upon
  7. them equally. Then if (they) want an extension, an extension is permissible for his partner, in
  8. renting the cooking-pots and clay jars, all of them. They agree that Dukhān will give to Raḍī
  9. one thousand half-(dirhams) of silver in the partnership agreement, against a load of fifty qintār of Ḥālūm,
  10. (Responsibility for) settling (accounts) is upon Raḍī, and R[aḍī received from Dukhān eight hundred]
  11. half-(dirhems), and a delayed (payment) of two hundred h[alf-(dirhems), he will pay him from them … //a hundred and sixty// on]
  12. Purim which is the first (payment), then f[orty at the Passover holiday, and each]
  13. one of them will act with trust[worthiness, and will strive completely …]
