Description

Legal document: bill of sale in which Makhlūf b. Jābir b. Nāṣir buys a house in al-Muʿizziyya (Cairo) from […] b. ʿAlī b. Ḥusayn b. Ibrahim b. ʿAlī, one of two trustees of Cairene legacies, under the supervision of Abū l-Ḥasan Masarra b. ʿAbdallāh. Makhlūf’s father, Jābir b. Nāṣir the miller, acts as his agent in the transaction. The house previously belonged to the wife of the amir, Sitt al-Dawla, and is apparently now intestate, hence the involvement of the trustees. 11th-12th century.   4. [                                                ] .................... للديوان الفرجي ولا موجود لها
  5. [                                                ] بحق ما جعل اليهما من ذلك وامرا به بمشارفة الشيخين ابى الحسن مسرة
  6. [بن عبد الله                                ] المواريث وقد علم هذان الشاهدان ان في  الثمن المذكور
  7. [                                          الدا]ر التي بالمعزية القاهرة حرسها الله خارج باب الفتوح بحارة
  8. [                                            نا]فذة ذات القاعة والعلو ومحيط بهذه الدار حدود الاربعة

  16. ابنه مخلوف وبامره الى هذين البائعين جميع الثمن المذكور في هذا الكتاب كاملا واستوفياه تاماً وافيا وصار جميعه
  17. في ايديهما للديوان الفرجى وابريا هذا المشترى وولده مخلوف من جميع الثمن المذكور فيه ومن وزنه ونقده من اليمين عليه
  18. او على شى منه براة قاطعة صحيحة براة قبض واستيفا وسلم هذان البائعان الى هذا المشترى جميع ما وقع عليه البيع
  19. [المذكور في] هذا الكتاب خاليا لا شاغل له وتسلمه منهما هذا المشترى وصار جميعه في يده ملكا لا [      ]

  1. Let the clerks' in the Farajī office act in accordance with it, after its being  registered, if God wills.
  2. [In the name of God, the merciful and compassionate. Praise be to God and his blessings] and peace be upon our lord Muḥammad, the prophet, and his family.
  3. [This is what Jābir ibn Nāṣir, the miller, bought from           ] ibn ʿAlī ibn Ḥusayn ibn Ibrāhīm ibn ʿAlī, the two trustees of legacies in Cairo, the guarded,
  4. [                                                ] to the Farajī office and it has no (moveable) assets
  5. [                                                ]by right of this being made over to them. They gave instructions for it to be carried out under the supervision of the two elders ʾAbū al-Ḥasan Masarra
  6. [ibn ʿAbdallāh             ] the legacies. These two witnesses recognized that in the aforementioned price
  7. [                           ]the house that is in al-Muʿizziyya - Cairo, may God guard it, outside Bāb al-Futūḥ, in the quarter
  8. [                           ]thoroughfare, containing a ground floor and an upper floor. This house is surrounded by four boundaries.
  9. [                      and the second boundary] of it, which is the northern, extends to the thoroughfare leading from the quarter
  10. [             the third boundary, which is] the eastern, extends to the side street, which is not a thoroughfare, and with it (i.e. the boundary) the two doors of the house communicate.
  11. [                 ]a third (?) belonging to the wife of the ʾamīr Sirr al-Dawla. Jābir ibn Nāṣir, the miller, bought for his son [ ] 
  12. [                 ] in Cairo, the guarded, all the house that is described in this [document        ]
  13. [                   ] constitute part of its rights and its water conduits constiute part of its rights, and its timber, bricks, doors
  14. [                    ] every right pertaining to it outside it and what is known to belong to it or is attributed to it, for forty-two
  15. [dīnārs, of standard weight, minted coin] of full weight and good alloy, free from brokers' fees and the tax of the town district, a sale without condition or promise. This seller handed over from the money of  
  16. his son Maḵlūf, by his authority, to these two sellers all the aforementioned price, completely. They took it from him in full and in its entirety and it, thereby, all passed
  17. into their hands for the Farajī office. They released this buyer and his son Maḵlūf from all the price that has been mentioned, from its value reckoned in weight and from its value reckoned in counted pieces, from the oath upon it
  18. or upon any part of it, with a decisive and valid quittance, a quittance of receipt  in full. These two sellers delivered to this [buyer everything that this sale,]
  19. [which is mentioned in] this document, entailed, free from any encumbrance. This buyer received it from them and it all came into his possession, as [       ] property [                 ]
  20. [                 ] with legal force and valid through this purchase [mentioned in this] document. This was after these people had acknowleged [                ]
  21. [                   ] and they separated from one another physically after the completion of this sale between them, satisfied with it and with the intention of carrying it out. Should any claim be made against
  22. [this buyer in what concerns this purchase, mentioned in this document, or any part of it or] in its rights by any person, then it is the responsibility of the Faraji office until [this buyer] receives
  23. everything that is his and everything that is due to him by right of this purchase,  mentioned [[in this document]] in it,
  24. [             after] it had been read to them and they had acknowledged that they  understood it and recognized it, they being in good health and legally capable of conducting their affairs.
  25. [                             ]Masarra ibn ʿAbdallāh testified to the acknowledgement by the two sellers and the buyer of what is contained herein on its date. Three copies.
