الوصف

Document of sale dated 456 AH. Marqūrah and Buṭrus are purchasing from ʿUqayl ibn Ḥudayj ibn Aḥmad who is introduced in the document as the field guard of Ṭuṭūn. His father’s name appears in one of the documents from ʾUqlūl where he appears as a witness. It seems that later on ʿUqayl moved to Ṭuṭūn, perhaps for work. They bought from him two feddāns of black (fertile) land for the price of eight dīnārs (see Chrest. Khoury II 20). The seller’s great grandfather is mentioned in the document. The northern border of the land extends to the property of Rababil ibn Mina with an additional information "alladhī ishtarāhu min Ḥamīd ibn Khayrī al-ʿĀmirī".   5. العامريّ اح دى خفرا هذه الناحية المذكورة اشتريا منه من جملة أرض حيازته في خليج معروف بشد سواف
  6. فدانين بحدها وحدودها الحد الاول وهو القبلي ينتهي الي ارض أبو شادان بن رديني
  7. و الحد الثاني و هو البحري ينتهي الي ارض المعروف بالملك لرببيل بن مينا الذي اشتراه من حميد
  8. بن خيري العامري و الحد الثالث و هو الشرقي ينتهي الي المنصل الذي بين ارض
  9. خليج بدومورة و هذا الخليج المذكورة و الحد الرابع و هو الغربي ينتهي الي هذا الخليج

  17. ذلك وخلاصه علي عقيل بن حديج من خالص ماله كائن ما كان وبالغ ما بلغ وكتب ذلك

  1. Admission of this was made before me. It was written by
  2. Ḥasan ibn ʾIbrāhīm ibn Rizq in his (own) handwriting on its date.
  3. In the name of God, the Compassionate, the Merciful
  4. This is what Marqūrah and Buṭrus, sons of Rabābīl ibn Mīnā ibn Ǧirǧah al-Ṭuṭūnī, have bought from ʿUqayl ibn Ḥudayj ibn ʾAḥmad ibn Hamid
  5. Al-‘Āmerī, one of the guards of the mentioned village. They bought from him all of the land under his possession in the canal known as Shaddi Suwāf
  6. to its limits and boundaries. The first boundary, and that is the southern one extends to the land of ʾAbū Shādān ibn Rudaynī.
  7. The second boundary, and that is the northern one extends to the land known as Malik belonging to Rabābīl ibn Mīnā who bought it from Hamid
  8. ibn Khayrī Al-‘Āmerī. The third boundary and that is the eastern one extends to the small irrigation channel that is [located] between the land of
  9. Badūmūrah canal and this mentioned canal. The fourth boundary and that is the western one extends to this canal
  10. and that is the canal of Shaddi Suwāf that waters this land. They bought this two feddāns for (a sum of) money which amounts
  11. in Muʿizzī coins of full weight eight dīnārs, the half of which is four dīnārs of gold coins.
  12. Aqil ibn Ḥudayj ibn ʾAḥmad received this price completely. He released himself from the (ownership) of these two feddāns by means of a receipt (acknowledging that he has) received and taken over (the price)
  13. fully and he has handed over the land to Marqūrah and Buṭrus the sons of Rabābīl ibn Mīnā and they received it from him, acquired it,
  14. and possessed it. It passed into their holding as property and their possession. If they wish they may sell, if they wish they may give it away as a gift.
  15. There is no claim for ʿUqayl nor any of his relatives over these two feddāns, neither little nor much,
  16. nor is there any cause for an action or claim. Whatever arises by way of an attachment, or right due, or if someone should suddenly appear with a debt or make a claim on the basis of any inheritance, its execution
  17. and its clearing is the obligation of ʿUqayl ibn Ḥudayj from his own money whatever it may be and whatever it may amount to. This was written
  18. in the beginning of Shawwāl of the year four hundred and fifty-six. God and his angels testified. God is sufficient as a witness.

Witness clauses

  1. Ṭāhir ibn ʿAlyān testified to the acknowledgement by the seller and the buyer of all that is contained in this document. He wrote in his (own) handwriting on its date.
  2. Ismāʿīl ibn Dāwūd testified to all that is contained in this document. This has been written by his son, ʿAbd al-Raḥmān, on his behalf by his instruction and in his presence.
  3. Ṣaliḥ ibn Muḥammad ibn Mūsā bn ʿAbd al-Raḥmān testified to the acknowledgement by the seller and the buyer and the collection of the price and what is herein. He wrote it in his (own) handwriting on its date.
  4. ʿAbd al-Raḥmān ibn ʾIsmāʿīl testified to the acknowledgement by the seller and the buyers and the collection of the price and what is herein. He wrote in his (own) handwriting on its date.
  5. Tamām ibn ’Aḥmad ibn Ḥudayj testified to the acknowledgement by ‘Aghīl ibn Ḥudayj of what is attributed to him. This was written by ʿAbd al-Raḥmān ibn ʾIsmāʿīl on his behalf by his instruction and in his presence.
  6. [on the right side] Ruzīn ibn Shabīb Al-‘Āmerī testified to the acknowledgement by ‘Aqīl ibn Ḥudayj of what is attributed to him. This has been written on his behalf by his instruction and in his presence.
  7. [on the right side] Muḥammad ibn Mūsā ibn ‘Ubayd testified to all that is contained in this document. This has been written by Ṣāliḥ, his son, on his behalf by his instruction and in his presence.
