الوصف
Document of sale dated 417 AH, twelve years after BL OR 4684.7. This time Rabābīl is buying from Kayl ibn Qūrīl. The object of the sale is Kayl’s inheritance from his father Qūrīl. This is a fourth, i.e. six shares of a new tower. He bought this quarter for a price of two and half dīnārs. It is also the only document from the collection that has writings on its verso. There are six lines of writing with a large size and large gaps between them and that do not seem to be related to the recto. The first line is not legible due to a large stain on top of the document. (information from Shomali, "Arabic Legal Documents") The document on the verso is a Fatimid state document ordering an investigation likely addressed to a judge. - هذا ما اشترا ربابيل بن مينا بن جرجة من کيل بن قوريل و هما جميعا من سکان الضيعة المعروفة
- بططون من كورة مدينة الفيوم اشترا [منه صفقة واحدة] عقدا واحدا جميع الربع و هو
- ستة اسهم من اربعة و عشرون سهما مشاع غيرمقسوم [..........]

- القبلي ينتهي الي حائط الشونة التي هي حصن البرج القديم الذي لقوريل بن كيل والحد الثاني

- كان عهدة ذلك كله وخلاصه ونفاذه وفكاكه علي كيل بن قوريل البائع من خالص ماله كائن ما كان
- وبالغ ما بلغ وذلك بعد أن وفقوا جميعا على المبلغ المذكور وقلبوه تقليب الشرى وافترقا بأبدانهم
- عن تراض منهما وذلك بعد أن قرئ عليها جميعا جميع ما فيه ما فأقروا بفهمه ومعرفته فأقرو ا
- في صحة عقولهما وابدانهما وجواز امرهما طائعين غير مكرهين و لا مجبرين وذلك في رجب سنة سبع عشر وأربع مائة
- وفيه لحق وهو الطريق المارة ودرب مينا بن جرجة وهو صحيح ويشر ع باب هذا البرج من حده

- The validity of this document is confirmed before me. It was written
- by Ḥasan ibn ʾIbrāhīm ibn Rizq in his (own) handwriting.
- In the name of God, the Compassionate, the Merciful
- This is what Rabābīl ibn Mīnā ibn Ǧirǧah has bought from Kayl ibn Qūrīl and they are both [numbered] among the inhabitants of the village of
- Ṭuṭūn, one of the villages of the district of Fayyūm. He bought [in one clapping of the hands and] in one contract, an entire fourth (of the property) and that is
- six shares of the twenty-four shares held in common, not separated […]
- aforementioned that he inherited from his father Qūrīl ibn Kayl and that is the […] new tower whose northern boundary extends to […]
- which forms the eastern border of the district and is adjacent to [the property of] Mīnā ibn Ǧirǧah. For the recognition of the tower its first boundary is sufficient, and that is the
- southern one which extends to the wall of the granary that is [located in the empty space between the layers of] the surrounding wall of the old tower which belongs to Qūrīl ibn Kayl. Its second boundary
- [and that is] the northern one, is (formed by) the thoroughfare. The third boundary, that is the eastern one, extends to the *the rest of the line has been crossed out. It is latter added in the addition at the end of the document*
- And the fourth boundary extends to the mound from which the passageway belonging to Mīnā ibn Ǧirǧah can be seen. Rabābīl ibn Mīnā bought
- from Kayl ibn Qūrīl, the seller, everything that was entailed by the sale, mentioned in this document, that is
- a quarter of the (property), i.e., six shares of the twenty-four shares of (the property) to its limit and its boundaries, including its lower floor and upper floor, its land and its sky
- Its bricks, its timber, its doors, its stones and all that is known as this tower and all rights that are associated with it
- all of this, its interior and exterior, for two and a half dīnārs of gold minted coins of standard weight. Kayl ibn Qūrīl, the seller, received it
- from Rabābīl ibn Mīnā wholly, fully, and including everything that was entailed by the sale and released him
- from them (the coins) and their price a quittance of receipt and handed it over to him completely. He acquired it. It passed into
- his holding as his property and into his possession. He has the same freedom of action with regard to it that owners customarily have with regard to their property and their
- possession. [This is] a sale without a promise or deceit, without option [to annul it], without restriction, not in the way of a pledge nor deposit, and without dispute.
- An irrevocable sale, a sale between Muslims. And whatsoever should ensue to Rabābīl ibn Mīnā, the buyer, (concerning what he bought), by way of a claim from a third party, whoever they may be,
- be they near or far, comer or on the way, claimant of debt and inheritance of this tower or not,
- The recuperation of all of this, its clearing, and its execution is obligatory upon Kayl ibn Qūrīl, the buyer, from his own property whatever it may be
- and whatever it may amount to. This is after they all agreed on the aforementioned price and investigated the property as it is required for purchasing. They separated physically
- after having made the contract to their mutual satisfaction. This is after all of what is herein was read to all of them and they acknowledged to their understanding of it and cognition of it. They acknowledged (this)
- in sound mind and body, legally capable of conducting their affairs, acting voluntarily, not forced or coerced, and this was in the month of Rajab of the year four hundred and seventeen.
- And there is an addition to [the document at the end of line 10] and that is: ‘the thoroughfare and the passageway belonging to Mīnā ibn Ǧirǧah’, and this is correct. ‘And the door of this tower, from its eastern side, provides access
- to the interior of surrounding wall that is around this tower. And this structure is included in the sale to its limit and its boundaries,
- mentioned earlier in this document’.

- Ubayd ibn Al-Ḥasan testified to all that is contained in this document and wrote with his handwriting on its date. Verified.
- Idrīs ibn Al-Ḥasan ibn ʾAbū Jiddah testified to all that is contained in this document and wrote with his (own) handwriting.
- Al-Ḥusayn ibn Mūsā testified to everything that has been mentioned and described herein. This has been written by Al-Qasīm ibn Mūsā al-Fāsī on his behalf by his instruction and in his presence on its date. Verified.
- ʿAbdul Ḥamīd ibn Mūsā testified to the acknowledgement by the seller of the sale and collection of the price and by the buyer of the sale and receipt. This has been written by Al-Qasīm ibn Mūsā al-Fāsī on his behalf by his instruction and in his presence on its date. Verified.
- Ḥusayn ibn ‘Ali testified to all that this document entails. This has been written by Al-Qasīm ibn Mūsā al-Fāsī on his behalf by his instruction and in his presence on its date. Verified.
- Dāwūd ibn ‘Abd al-Raḥmān testified to all that is contained in this document. This has been written on his behalf by his instruction and in his presence.

- And it is obligatory, God willing, to consider an investigation of the situation concerning what he revealed
- And the mentioned man will appear in front of you and he will be required to fulfil that which is required of him by the
- Conditions of the ḍamān (‘the guarantee against defect’) and prevents him from requesting a delay. Indulgence
- And his is not to give him any permission in that matter.
- Then do so, if God wills, by a promise and without any indulgence in that regard.
