Description

Deed of sale for a house. In Arabic script. Dating: 11th–12th century CE. Ḥusayn b. Ḥāzim al-Bayyāʿ (the food vendor) purchased a house from Ḥasan b. ʿAlī al-Baqqāl (the grocer). (Information from Khan.)

  1. In the name of God, the merciful [and compassionate].  

  2. This is what Ḥusayn ibn Ḥāzim, the (food-)vendor, bought from Ḥasan ibn ʿAlī, the grocer. He bought [from him …  ]

  3. his possession. It is a house with two doors, a lower outbuilding known as a stable and two upper dwellings [ … ] 

  4. Bilāl, the farrier, situated in the large cul-de-sac street known as the street of ..  [ … ] 

  5. from its door and proceeds into its courtyard. This large house enclosure, which has just been mentioned, is sufficiently well know [ … ] 

  6. The first boundary, which is the southern, extends to the courtyard of this  aforementioned house enclosure. Its second boundary, [which is the northern],  

  7. extends [to the house] that was known (by the name of) the heirs of Aḥmad ibn Ḥasan, then (by the name of) Abū ʿAṭṭāf, and to the courtyard [ … ]  

  8. Its [fourth] boundary, which is the western, extends to the stable known (by the name of) Yaḥyā ibn Khiḍr .. [ … ] 

  9. its roof and its conduits, together with its rights and ways that pertain to it, (be  they) few or many [ … ]  

  10. of it. Everything that was entailed by this sale, mentioned in this document, (was sold for) .. [ … ]  

  11.  nor promise relating to it, which would invalidate it; and Ḥusayn ibn Ḥāzim, the  (food-)vendor, the seller (of the property), paid to Ḥasan [ibn ʿAlī, the grocer, … ]  

  12.  completely, in full weight. He (the seller) released this buyer, and also his  descendants and heirs, from all of it and from the oath [ … ]  

  13. This seller delivered to this buyer everything that was entailed by this sale, mentioned in this document, [ … ]  

  14. This (took place) after these two transacting parties had acknowledged that they  had both seen this house, which is described in [this document … ]  

  15.  . ........... after releasing him and his relatives, and that was clear to them and they  recognized it when [contracting this sale. Should any claim be made against this  buyer]  

  16. by any person concerning what this aforementioned sale entailed, or any part of  it or of any of its rights [ … ]  

  17. regarding returning the price and vouching for a value, whether small or great, and he (the seller) acknowledged that he was sufficiently solvent (to return) the  sum of the price mentioned in this document [  …  ]  

  18. what is contained herein, after it had been read to them, and they had acknowledged that they had understood it and had taken cognizance of it, word by word, they being in good health and legally capable of conducting their affairs.  This took place on the [ … ] decade [ … ]
