Description
Document of sale dated 447 AH. There are many parties to this sale. The buyers are Marqūrah and Buṭrus, the two sons of Rabābīl, who is the buyer in Bl OR 4684.6 and .7. The sellers are Nahīf, Bilāṭis, Bajūsh, and Qīwarhanūd Qraqīl. There is no mention of the sellers in other documents. All that is known based on their description in this document is that they are all brothers and their father is an individual by the name of Mūbah. According to this document, they sold two rooms and their share of the ruins south of this house. They sold this for four dīnārs and three quarters. - بسم الله الرحمن الرحيم
- هذا ما اشترا مرقوره و بطرس ولدی ربابيل بن مينا بن جرجة الططوني من نهيف و بلاطس و بجوش و قيورحنود
- قرقيل اولاد موبة بن ينوحن و هما جميعا من اهل الضيعة المعروفه بططون من بعض قرى كورة الفيوم من صعيد مصر
- و اعمالها اشتروا منهم صفقة واحدة و عقدة واحدة تسعه عشر سهما و خمس سهم من اربع و عشرين سهما مشاع غير مقسوم
- في الدار المعروفة بدار اولاد منارة و هما الغرفتين من الجانب الغربي من هذه الدار الكبيرة و حصتهم من الخراب القبلي من هذه الدار
- و العامر منها بحده و حدوده و مدخله و مخرجه و سفله و علوه و خشبه و ابوابه و طوبه و حجارته و كل من هو لها داخل فيه و خارج
- منه و ما اشتملت عليه حدود اربع حده الاول القبلي ينتهي الي الخراب القبلي من هذه الدار و حده الثاني البحري ينتهي الي مجلس اشو ط
- بن ثيدر و منه المدخل و المخرج و حده الثالث الشرقي ينتهي الي غرفة لمينا جرجة بن شنوده و حده الرابع الغربي يتنهي الي الخراب الذي
- يلي بين دار الاسقف اشتريا جميع ذلك بمال مبلغه من العين الوازن بوزن التجار و نقدهم اربع دنانير و نصف و ثلث
- قبضوا هاولاء البيعين المذكورة في صدر هذه الوثيقة من مرقورة و بطرس ولدي ربابيل بن مينا بن جرجة الططوني هذا الثمن
- تاما وافيا و ابروهما من نقده و وزنه او الثمن عليه او علي شي منه براة قبض و استيفا ثمنا لجميع حصتهم من العامر و الخراب من جميع
- هذه الدار المذكورة وسلموه الي مرقوره وبطرس ولدي ربابيل بن مينا بن جرجة الططوني جميع ذلك وحازه وملكه وصار مالا
- من اموالها وملكا من املاكها على شرط بيع الإسلام وعهدته يتصرفا فيه تصرف الملاك في أملاكهم لو شا باعا وإن شيا وهبا وإن شيا
- صدقا وإن شيا سكنا بيعا صحيحا ناجزا قاطعا نافذا ممضيا لا شرط فيه و لا خيار و لا في شيء منه ولا تأول ولا فسخ و لا منازعة ولا
- استثنى ولا مثنوية ولا بسبيل رهن ولا وديعة وضمنوا لها جميع الدرك من سائر الناس كافة وافترقا البائع والمشتري بعد ان
- قري عليهم هذه الوثيقة وعلم كل واحد منهم ما له فيه من الحظ والصلاح بعد ضمان جميع الدرك في جميع ذلك من خالص اموالهما كانتا ما
- كانت بالغا ما بالغ وذلك في صحة عقولهم وأبدانهم وجواز امورهم غير مكرهين و لا مجبرين ولا مضطهدين طيبه بذلک انفسهما و كتب في العشر الاول
- من ذي الحجة سنه سبع و اربعين و اربع مائه شهد الله و ملائكته و كفا بالله شهيدا و الحمد لله وحده

- In the name of God, the Compassionate, the Merciful
- This is what Marqūrah and Buṭrus, the sons of Rabābīl ibn Mīnā ibn Ǧirǧah Al-Ṭuṭūnī, have bought from Nahīf, Bilāṭis, Bajūsh, and Qīwarhanūd
- Qraqīl, the children of Mūbah the son of Yinawḥin. They are all [numbered] among the inhabitants of the village known as Ṭuṭūn in the district of Fayyūm in upper Egypt
- and its administrative districts. They bought from them in one clapping of the hands and in one contract nineteen and a fifth shares out of the twenty-four shares held in common, not separated
- of the house known as the house of the children of Minārah. These (shares) consist of the two rooms in the western side of this mentioned house and their portion of the ruins south of this house
- as well as the inhabited parts of it, to its limit and its boundaries, with its entrance and exit, its upper part and lower part, its timber, its doors, its bricks, its stones and all that is in it
- and what its four boundaries entail. Its first boundary, the southern one, extends to the ruins south of the house. Its second boundary which is the northern one extends to the living room of ʾAshwaṭ
- Ibn Thaydar and the entrance and exit are from this side. Its third boundary which is the eastern one extends to the room of Ǧirǧah ibn Shanūdah and its fourth boundary which is the western one extends to the ruins that
- is located between [this property and] the house of the Priest. They bought all of this for (a sum of) money which amounts in gold minted coins of full weight according to the weight of the merchants to four and a half and a third dīnārs.
- They received the price mentioned in the beginning of this document from Marqūrah and Buṭrus, the children of Rabābīl ibn Mīnā Ǧirǧah al-Ṭuṯūnī. [They received] this price
- completely and in full. And (the sellers) released them (i.e., the buyers) of its weight and price by means of a receipt (acknowledging that they have) received and taken (it) over fully. (They received the price) for all of their share (which is) both the inhabited part and the ruins of
- this mentioned house. They (the sellers) delivered it to Marqūrah and Buṭrus, the children of Rabābīl ibn Mīnā Ǧirǧah al-Ṭuṯūnī, all of this and they acquired it and possessed. It passed into their
- holding as their property and into their possession. (This sale was fulfilled) according to the condition of sale of Islam and its contract. The buyers can act freely with regard to the property the way owners act with regard to their properties. If they wish they may sell. If they wish they may give it away as gift, if they wish they may
- give it as charity, and if they wish they may reside in it. (This is) a valid sale, that is complete, decisive, effectual and (fully) completed in which there is no condition and no option of return of all of it or on any portion thereof, and no review, and no termination, no dispute and no
- restriction or reserve, not in the way of pledge nor deposit. And they guaranteed (taking responsibility) regarding any claim made by other people. The sellers and the buyers separated after
- this document was read to them and each of each of them became aware of what gains and advantages there were in the contract for them. (This was) after (the buyers) took responsibility to indemnify any (future) claim made by a third party against any part of it from their own money whatever it may
- be and whatever it may amount to. )They did this while) being in sound body and mind, legally capable of conducting their affairs, acting voluntarily, not forced or coerced, and they were pleased with this. The document was written in the first ten days
- of Dhil Ḥijjah of the year four hundred and forty-seven. God and his angels testified, and God is sufficient as a witness. Praise is due to God alone.

- ʿAlyān ibn ʾIbrāhīm testified to all that is contained in this document and wrote in his (own) handwriting on its date.
- ‘Ilmān ibn ʿAlyān ibn ʾIbrāhīm testified to all that is contained in this document and wrote in his (own) handwriting on its date.
- ‘Abdullāh ibn ʿUbayd ibn al-Ḥasan ibn al-Wajīh testified to all that is contained in this document and wrote in his (own) handwriting on its date.
- ’Afam ibn Yūsuf ibn Wahab testified to the acknowledgement by the acknowledgers of what is in this document and wrote in his (own) handwriting on its date.
