Description

Legal document(s) in Arabic. Involving a ḍamān (tax guarantee) and ḍumanāʾ (tax guarantors). Dating: 1101–21 CE, based on the invocation of the caliph al-Āmir (r. 1101–30) and the vizier al-Afḍal (r. 1094–1121) (verso, ll. 6–8). Verso is an iqrār (acknowledgment) made by Ibrāhīm b. Sulaymān, ʿAlī b. Ḥasan, and Yaḥyā b. Mūsā, and perhaps another person (it's also possible that the names are split differently, since the "wa-"/and and the "bin"/son-of look nearly identical). Recto is a set of first-person testimonies stating that "I attended the aforementioned audit/investigation/survey (kashf)" and that everything "in it" is accurate and that the iqrār of the ḍumanāʾ (referring to the document on verso?) is accurate. The statements are signed respectively by Yaḥyā b. Ismāʿīl b. Muḥammad b. [...]; Khalaf b. Ibrāhīm b. Mubārak(?); and Ismāʿīl b. Mūsā b. Muḥammad. ASE/MR

  1. حضرت الكشف المذكور والامر على ما ذكر ووصف فيه

  2. وشهدت على اقرار الضمنا المذكورين [فيه بما يضمنه] هذا

  3. العمل بالموجود المذكور وكتب يحيى بن اسمعيل و[محـ]ـمد بن سلم بتاريخ 

  4.                         عشر جمادى الاولى

  6. وشهدت على اقرار الضمنا المذكورين فيه بما يضمنه هذا العمل بالموجود

  7. المذكور وكتب خلف بن ابرهيم و مينا بن ناسارس؟ مبارك؟ وكان؟ في التاريخ

  9. وقفت على هذا العمل وجدت [الكشف] في الامر على ما ذكر فيه وشهدت

  1. I was present at the aforementioned inquest, and the matter is as mentioned and described herein.
  2. I testify that the guarantors mentioned [in it] have acknowledged [that they guarantee] this
  3. assessment in the aforementioned presence. Yaḥyā b. Ismaʿīl and Muḥammad b. Salim wrote it on the date:
  4. 10 Jumāda I.
  5. I was present at the aforementioned inquest, and the matter is as mentioned and described herein.
  6. I testify that the guarantors mentioned herein have acknowledged that they guarantee this assessment in the aforementioned
  7. presence. Khalaf b. Ibrahīm and Mīnā b. Nāsārus(?)/Mubārak(?) wrote it on the date:

  9. I was present at the assessment and I found [the inquest] into the matter to be according to what is mentioned herein. I testify

  6. اقر كل واحد من ابرهيم بن سلامة وعلي بن حسن بن يحيى وموسى بن موسى بن ابرهيم وخلف بن نسطورس  وصدقة بن حسن

  7. ضمنا الحق المعمور … لضمنا المذكورين واشهدوا على نفوسهم طوعا في صحة منهم وجواز امر من غير قهر ولا جبر ولا اكراه منه

  8. ان هذا العمل عملهم ورفعهم بجميع املاكهم بالاجر (؟) المذكور وانهم لم يحقوا منها شي قل ولا جل

  9. واضمنوا ما كتب به المذكور حق لمولانا وسيدنا الامام الامر باحكام الله امير المومنين صلوات الله عليه وعلى

  10. ابائه الطاهرين وابنائه المنتظرين وفتاه السيد الاجل الافضل امير الجيوش سيف الاسلام

  2. Legal (?)
  3. In the name of God, the merciful, the compassionate.
  4. A record of it:
  5. This inspection (occurred) on the date mentioned herein.
  6. Each of the following acknowledged (it): Ibrahīm b. Salāma, ʿAli b. Ḥasan b. Yaḥyā, Mūsā b. Mūsā b. Ibrahīm, Khalaf b. Nasṭūrus and Ṣadaqa b. Ḥasan,
  7. guarantors (ḍumanāʾ) of debt to the government ... for the aforementioned guarantors. They testified voluntarily, in sound health and permissible state, without coercion, force, or compulsion,
  8. that this assessment is their assessment and their submission, entirely their property for the aforementioned wage (?), and that they have not withheld anything from it, whether small or large.
  9. They guaranteed what was written herein as a debt to our master and lord the imām al-Āmir bi-aḥkām allāh, commander of the faithful, blessings of God be upon him and upon
  10. his pure ancestors and awaited descendants, and (to) his servant the most lofty lord al-Afḍal, commander of the armies, sword of Islam,
  11. supporter of the imām, guardian of the judges of the Muslims, guide of the missionaries of the believers, may Allah strengthen the religion through him and grant the commander of the faithful enjoyment through his long life.
